Georgia Judge Puts Bias Before The Law: Trashes Constitution And Res Ipsa Loquitur

A Georgia federal district court judge, Clay Land, in United States District Court once again turned down a valid challenge by a U.S. citizen with respect to the eligibillity challenges which have been undertaken by several different groups previously calling for production of Barack Obama's birth certificate as confirmation of his lawful natural born citizen status per the express terms of the U.S. Constitution with respect to any individual holding the highest office under it.
It appears that this particular judge no longer holds the common law, and codified law of the United States of "Res Ipsa Loquitur" (the thing as it speaks ) with respect to Constitutional interpretation.
And ignoring such a clear legal duty and provision with respect to the judiciary to make a clear and judicious review of such documentation for both legitimacy and legality is clearly in order here.  Especially since this nation is still involved in a "global" war on terror, and now domestic spying program post 9/11.
Of course, while our own borders still remain unsecured, and the Bush Administration then also afforded over 43 countries free pass Visa waivers with 48 hour turnaround security checks prior to his leaving office.
I think most individuals would agree, that such a provision was made for obvious reasons by the founders.
So that no other allegiance or loyalty to any other country, or their interests, would precede the president's duties and obligations to this country and its citizens in the carrying out of his official duties and functions.  Especially as Commander in Chief of the military.
And this particular case was brought by a soldier who owes allegiance to both this country and its Commander in Chief while on active duty.
And considering Mr. Obama's rather unusual upbringing, much of which was clearly outside the United States which he fully admits, and as a lawyer himself would appear would see the clear need for such provision.
Since political parties themselves were also not at all included as "legal" parties to the Constitution at the outset.  Since those federalists and anti-federalists actually settled their differences upon the ratification process, and agreement and later enactment of Patrick Henry's Bill of Rights in order to protect the "people" from abuses of both their federal and state government with respect to the "unalienable" rights stated thereunder.
The judge clearly showed his bias, and actually disdain for the Constitution in his further comments, calling such requests and measures from LEGAL U.S. citizens in this country, "frivolous."
And yet the federal government under the stimulus enacted legislation calls for the creation of a National Health Care Database containing all Americans very private medical records through their now obvious "state actors," the health insurance industry and their associated organizations ala the East India Tea Company and their "favored status" with the British sovereign at the time of the original revolution?
And are continuing on legislation with respect to this health care deform which is and has been clearly disputed as outside their also legal authority, and Constitutional duties and functions other than to regulate those industries more significantly in order to reduce those costs, since it has been the costs, not the availability, that has been the major problem for most of those that still remain uninsured.
Or denials in honoring most of the representations of many of those agents which sold them to the American public now progressively, in even renegotiating and changing the provisions unilaterally in many instances without any notice, or negotiation of the insureds paying those horrendous premiums.
While closed door meetings were held with the industries on these measures, and it appears will also be so convoluted again with hundreds of pages of legalese involved in order to further give the lawyers in this country and the ACLU another stimulus at the public's expense, the federal courts are now denying proof of the clear eligibility of a publicly paid employee that is facilitating now "fining" citizens in order to once again increase Washington's bottom lines and the insurer's and their stockholder's profit margins and capital gains?
The judge also stated that such a matter was not a "duty" of the court, and went so far as to state that if he so ordered proof, that this would open the door in the event a potential candidate lied about his age in order to gain office.
This just goes to show why Washington said that political parties in and of themselves could destroy this nation from within, if foreign interests didn't do so from without.  And it appears that both the political parties and their "foreign" interests are doing just that "progressively."
And since this off-the-wall ruling that flies in the face of all manner of law and the hundreds years precedent of res ipsa loquitor that precedes it with respect to Constitutional interpretation (which few judges have followed also in the past which also has lead to where we are today, an "unrepresentative" government on every level), I wonder if the district court judge involved just so happened to go to Harvard also.
Which apparently is also either teaching more and more British based "precedents" in this country as law, or is also even at those six figure per semester tuition rates, another of our failing schools.
I bet this one comes up when or if Arnold Schwartenegger decides to take a run for the roses.
But as with our liberally cluesless media, if that is the case and another such movement should occur, I doubt that those individuals will be called "birthers," as has been the spin placed by the Obama worshippers come hell or high water (and hell is looking pretty good to some of us at this point after these first eight months in the levels of back door taxation and property thefts of the citizenry are concerned for Mr. Obama's global agendas ala Bush).
They will simply be called Americans.
And any judge that would in any such event so rule as Mr. Land has in this case, Benedict Arnold.
My only problem with this entire matter is that insofar as my beliefs, Mr. Obama clearly does not fulfill the "intent" of the founders also with respect to the entire provision, and the background from which it came and reasons therefor. And why this particular case was brought in that federal district is beyond me, when it is not really one of the most Constitution honoring jurisdictions to begin with historically in some of their renderings in the past, along the lines of the 9th Circuit in wacko California, so liberal that it also doesn't recognize the Constitution in any manner whatsoever as of late.
And due to the hijacking of our entire government by two mainstream political parties at this juncture without any also Constitutional basis in fact, not "duly elected" per the judges also stated reasons for his refusal in that the "people had chosen" the president (right, and just what were the choices, your honor, since the two political parties have an inside track on the entire process and accept even campaign donations and/or sponsorship from foreigners at this point, and were illegally elected even to Congress in the first place, having accepted "foreign" campaign donations and sponsorship and thus not "representatives" of the citizeny of their respective districts in any manner whatsoever and thus in violation and "pretenders" at this point in violation of the entire basis for the election of candidates for the representatives government written within the clear terms of the Constitution itself.
At this point, not at all "representatives" solely of the districts in which the were elected but more so the national and global lobbying organizations, or even foreign countries lobbyists and their interests.
But just look at what the alternatives are in any event also.
Joe Biden, with Nancy Pelosi second in line?
Hell doesn't even begin to describe that pairing, and the additional havoc they would pile on top of the already crushing burden on the middle and lower income classes and "average" Americans.
And the other branch doesn't clearly know the meaning of the term "conservative" at this point, but simply another branch of the Global Socialist Party but with different and in some instances in varying degrees, even overlapping global corporate benefactors, that's all.
Hail Britainnia.  It appears that Congress and those on the Hill are selecting more and more "British trained" globally focused "global socialist" also judges for high federal office in order to protect also their job security, and power trip moves.
Such as those educated at Harvard, Oxford, Stanford, and those East Coast "ivy league" schools whose law school programs clearly have been teaching the British style of government with the "government as sovereign" mindset.
And appears clearly are not at all teaching the "intent" of those founders behind much of the provisions of both the Bill of Rights, and the Constitution itself.  Nor clear distinctions between the "limits" of and their obligations with respect to their function and  their true powers and duties.
And this one was clearly their function and duty, without any "rights of refusal" whatsoever included within the document which actually provides for Mr. Land's lofty salary, and that of his staff.

The Pig Industry Revolts: Swine Flu Now Politically Correct H1N1 Virus

It appears in our not simply nationally politically correct society but now also "globally" politically correct, spokesmen for the World Health Organization have now  temporarily renamed the Swine Flu virus by its clinical name, Influenza A (H1N1).  The United States Department of Homeland Security is following now in lock step.

It seems that there were some concerns and proof that the pork industry was having difficulty getting "this little piggy to market," due to now the psychological connections between the virus and the carrier.  Except the World Heath Organization has also now qualified its stance on just whether or not pigs ARE the actual carriers.

Or just how it is transmitted between pigs and humans, although as a virus primarily attacking the respiratory system there is absolutely not a shred of evidence to suggest that ingesting or eating pork is connected.  Unlike the e coli virus which has been proven can be transmitted by ingestion of  both raw infected eggs and poultry.

Here are some other animals and insects who have been connected, fairly or not, to human disease:

dogs, cats, bats, skunks, raccoons - rabies

cows - "hoof and mouth," "Mad Cow" disease

ticks - Lyme disease

mosquitoes - West Nile, yellow fever, malaria

chickens,eggs - ecoli

tuna, shellfish - mercury poisoning

apes, monkeys - HIV

The swine, unfortunately, also has that carryover bad rap in other cultures and some religious connections to overcome as far back as biblical times due to both allegorical connections and dietary prohibitions, and its propensity in times past to be a carrier of disease before the refrigerator and freezer were invented.

It seems the pig family is now suffering from unfair discrimination.

Since 10,000 times the amount of lives have been lost due to the open Southwest borders in Ms. Napolitano's former home state, this former Arizonan wishes she would have been so "Johnny on the spot" protecting Arizonans eight long years ago after 9/11 and prior to the now Mexican drug wars and kidnappings there.  They appear to be still conducting business as usual.

A suggestion was made by one of the directors of the WHO that maybe a contest should be run in order to rename the virus to give it a less scientific, and more commercially accepted identifier within the non-Latin speaking, scientifically challenged portion of the population.

I came up with several:

Hog Native

Hemispheric Navigational (globally transferred)

Hispanic Neutral (originating in Mexico, affecting anyone)

or how about:

The HeiNie Virus (you know, as in "backside")

USDA and WHO:  Are those politically correct?

Maybe we should just call it "Global Economy Meltdown Sydrome"  (GEMS).  That surely is a psychological boost for the pigs, supermarket and people.

I think personally I just might fast.

Obama Picks Koh, Transnationalist, For Top State Department Post

Apparently the global socialism agenda is speeding right along here in the United States under the Obama Administration.

Latest news:  Mr. Obama's pick for a high level post, Harold Koh, in the State Department.

Mr. Koh is a self-described "transnationalist" (globalist) who is dean at Yale University, a rather "government" focused "liberal" university of higher learning.

By "government" I mean so "liberally" construing the United States Constitution to actually throw it and its provisions out entirely, relying on the study of "judge made" or "case law," almost entirely, and particularly reading into their function the ability of the judiciary to actually amend it in its interpretation outside Constitutional provision if they can come up with a well founded "political" interest to support their transgression. 

Like the Kelo decision and a great many other of those "progressive" renderings, favoring the state or corporate interests if there is some "general welfare" of the state involved over the citizens.

Similar to Oxford in England - a country which America fought its original revolutionary war in order to escape that country's dominion and control.

And apparently, Mr. Obama is as bent on reversing that war as his predecessor, George Bush, was in favor of using international treaties and laws in order to circumvent the restrictions placed in the U.S. Constitution over the federal government in this country.

In fact, Mr. Bush was so "liberal" he essentially threw it out entirely.  And it appears Mr. Obama, although presented as a Constitutional lawyer to the American people during the campaigns, is also anything but in a great many of his stated positions, and has now described himself as a "citizen of the world" during his recent European tour.

Both Mr. Obama and Mr. Koh have believers and fellow transnationalists in our Congress, and even now sitting on the U.S. Supreme Court.

Recently, Justice Ruth Bader Ginsburg had this to say about foreign law, and it's place on judicial interpretation with respect to matters that come before the U.S. Supreme Court:

“I frankly don’t understand all the brouhaha lately from Congress and even from some of my colleagues about referring to foreign law. . . . Why shouldn’t we look to the wisdom of a judge from abroad with at least as much ease as we would read a law review article written by a professor?

How about neither, Justice?  How about simply reading and applying the U.S. Constitution in your determinations?

It appears that it just may be time for Justice Ginsburg to consider retirement, as it appears she may be a little unsure to which "law" her oath of office is to, which even provides for and grants her that lofty position on the bench.

It appears those Tea Parties which were staged recently by the American people who are getting increasingly upset at the selling out of our country to "foreign" interests by many who have abandoned their oaths of office on the Hill, including the former and current presidents, many in Congress and those also holding high office in the judiciary now, just may have had more than justifiable reasons and legitimate concerns after all.

"Go Green" And The Global Greeners

It has been interesting to watch and listen to the "new" political party, global socialists,  (who spread on both sides of the American political aisle in the form of Dems or Republicans) and their rhetoric with respect to global warming, and the emphasis now on "Going Green," in the new Obama Admnistration.

At this point, I'm simply wondering if this new cause celebre out of Hollywood and the Globalist Party is the same as the Green Movement of the 60's.  The ones that were responsible for "saving the trees" and all that, who have now merged our two party system now into one focused on the "global economy" and "global free trade" for their corporate and personal interests. 

Those now responsible for the wildfires in California, North and Southwest and the timber waste and devastation continuing forty years later in dense, overgrown forests that are set off by lightening, or even static electricity, and then burn and destroy thousands of acres because the trees are now so dense that the flames spread out of control within a few short minutes.

Of course then abandoning their homes while still wet from their dip in their pools or spas - during, of course, the worst drought conditions in many years.  And battling Arizona, a desert state, over water whose forests also have suffered severe wildfires in the last several years due to those same "save the trees"  60's Greeners in that state.

The ones that prevented the timber and lumber industry from cutting down some of those trees, or even buying some of that land in order that "nature" was preserved in it's pristine state.

The ones that would bend over backward in order to "save the animals," castrated George W. Bush (although his presidency will go down in infamy due to his own liberalism with the Constitution), yet seem to be blinded to just how far Mr. Obama has strayed from his campaign rhetoric, and his minions sliding the cash over to those bankers who also were instrumental in funding his own campaign - and was instrumental in getting that bank bailout bill passed back in September.

The ones who fought for "cleaner fuel" and energy also in the 60's, but who didn't want those "ugly" wind towers in their own backyards due to the fact that the towers ruined their view of nature in all it's glory.

The ones who push for electric cars, but heaven forbid we build a nuclear power plant in order to upgrade the technology which would be needed to "Go Green" with electrically powered automobiles in this country in the amounts that would be necessary.

The ones who hold office on the Hill, yet fly their private jets and make unnecessary trips to foreign nations when they could be "Going Green" by using faxes and teleconferences in this blighted economy.

Just how many trips to Mexico and how many U.S. federal officials are needed in order to appraise the U.S. border situation?

Especially since the head of DHS is the former Governor or Arizona and should by now have enough information with respect to the declining border situation to fill twenty or thirty volumes on her recyclable paper.  After all, she is one of those on the Hill that is primarily responsible for this situation escalating due to her negligence in supporting the needed fencing that would curtail the drug trafficking to begin with.

The cartels do not cross at the ports of entry, so those new gadgets Ms. Napolitano is buying with the stimulus monies will have no effect whatsoever on the problem.

With Mexico blaming the U.S. for the ammo in which these cartels are equiping themselves, you would think that Mexico - if it was truly interested in stopping these drug cartel members - would actually be supportive of getting those borders fenced and secured so they could contain the problem.

The caliber and amount of guns with which the cartels are now armed could not have been smuggled through the ports of entry without assistance from Mexico's customs agents themselves.  It's a little hard to hide heavy artillery, even in a Humvee.

Instead of "green" fencing, we are equipping the Mexican government with high octane Black Hawks to fight their war, courtesy of the U.S. taxpayers.

Now they've even figured out a way to tax the air we breathe.  Its called a "carbon tax."  It's for the good of the planet, and Washington's wallet in order to spread more of America's generosity throughout the world, even while it's citizens continue to lose their jobs and homes left and right due to Washington's generosity on behalf of the American people (without, of course, their consent, i.e., taxation without representation).

I think I've figured out the type of "green" the new party, global liberals, actually mean when they use the term.  Finally.

U.S. dinero. Americanos dollars.

AIG: Obama, Dodd's Mea Culpas Sound Hollow

In the continuing saga of the AIG executive bonuses which were extended Sunday by Timothy Geithner and the Department of the Treasury, another player has stepped up to the plate in addition to President Obama's rather weak excuse for an apology to the American people over this "sleight of hand".

Christopher Dodd, that erstwhile senator and former Presidential candidate, has now taken the blame for inserting a sentence into the bank bailout bill that was rushed through Congress last September that afforded the AIG executives to receive these million dollar bonuses.

It appears with Mr. Dodd's "mea culpa" another attempt for those on the Hill to now shift blame from the President and Mr. Geithner, and of course hope on the generosity of the American people to let bygones be bygones. Let's spread the blame around so that we can actually take the focus off what occurred initially that lead to this situation, and blame it on one Congressional member who inserted a sentence in the bill that make the entire bailout itself somehow seem legitimate.

There are two things wrong with this little deception. Many in America are not buying it.

To encapsulate actually what occurred and who is truly to blame, note below:

1. In September under "terrorist warnings" from Secretary Henry Paulson all members of Congress were held over in Washington from their campaign junkets in order to address this "emergency" bank bailout. Otherwise, the American people were informed, Wall Street would crash and their ATM cards would not work.

2. Prior to this catastrophe, two other large financial institutions, Goldman Sachs and Lehrman Brothers, also faced eminent demise. Congress refused to bailout Goldman or Lehman Brothers, although Warren Buffet stepped up to the plate and helped out Goldman Sachs. It just so happens that both Goldman Sachs and Lehman Brothers are part owners of our own Federal Reserve. How they could be then "bankrupt" is beyond the realm of feasibility for most Americans to comprehend.

3. For the first time in history not only were U.S. based corporate interests involved in this bailout, but a globally based insurer, AIG, was also begging on the steps of the doors of Congress. No matter also that many of these banks and AIG had been heavy contributors to the campaigns of a majority of those in Congress to whom they went begging.

4. The bill was drafted in haste in order to rescue America's economy, and consisted of enough pages to insure that any disinterested Congressional member had no time in order to digest the terms of the bailout. This does not excuse them in any manner, however. In such an instance it was their duty to abstain at the time from voting based on those grounds, and the clearly questionable Constitutional basis for this entire bailout to begin with at the eventual American taxpayer's expense.

5. The measure passed with just a mere two vote margin. Which historically indicates that there was some heavy back room dealing, and also still maybe some who did have enough integrity left (few, I know) to realize the entire bailout itself was a violation of our Constitution by the mere inclusion of a foreign corporate concern at it's outset. AIG's real financial problems, if any, were caused by their London Mayfair office, from all reports.

6. Included within the bailout were other unconstitutional provisions. Namely, a transfer by Congress of their Constitutional powers with respect to foreign agreements, whether public or private, to the Executive office. Such a transfer of power could not legally be accomplished without a Constitutional amendment in and of itself.

7. Rather than this being handled as a corporate restructuring under the provisions of the U.S. bankruptcy code, Mr. Geithner was strictly given unilateral oversight and authority. In other words, Mr. Geithner is now acting as "trustee" for the restructuring, and his "fiduciary duties" are not to the executives or AIG, but to the creditors - the American public and AIG's former stockholders. Thus, when Mr. Geithner and Mr. Obama claim they had no legal power to refuse, they not only had the legal power to do so, they had the legal obligation on behalf of the American people to do so.

And at this point, a good 2/3rds the members of Congress, Mr. Geithner and Mr. Obama should be wearing stripes about now, with all the legal and criminal Constitutional violations that have thus far transpired in this fiasco.

The Continuing Strife in the Middle East

Since it is more than clear to most Americans at this point that America's continued presence in the Middle East in both Iraq and Afghanistan is not at all primarily as a response and defensive mission with respect to the attacks on this country by Osama bin Laden and the Taliban in September 2001, but for purely economic reasons - i.e., oil and the "jobs and the economies" of selected government military contractors, I recently stumbled across some rather interesting facts which has complicated my theories about why we are continuing to fight this "no win" war against an enemy whose entire belief system is based upon martyrdom for their cause, and also the silence in the media for now six long years in the amount of civilian and other casualities which have been the result of this engagement.

After discovering this new information, my views on the absurdity of the continuation of U.S. involvement in the Middle East outside capturing bin Laden became even more pronounced.

I had believed that the U.S. did intend to redress 9/11 bringing bin Laden and all who may have been directly involved to justice even after the lie of weapons of mass destruction was revealed. I also believed that the recent crisis in Gaza were separate and isolated events involving two different hot spot issues, and two splinter terrorist organiations. However, after my research my questions changed to (1) Is it possible that the gist of the ongoing strife in the Middle East as also exhibited by the recent bombings in Gaza could be much more complex than simple disputes over land and territory? (2) Could it be also that there are fundamental religious differences that impact the economy of these countries that make any resolution or compromise tenuous at best, and that the U.S.'s support for Israel, right or wrong, might have also a self-serving aspect to it for not simply needed oil, but further economic reasons due to Washington's shift from "national" interests to an increasingly "global" one per the One World Government agendas of the CFR and UN's Resolutions?

In researching the current financial collapse and banking crisis in the United States, and the amounts of rising banking interests rates in this country due in large part to lack of any adequate regulation at either the federal or state level of banking practices in this country, I came across some interesting information from Wiki. It involved interest rates made between creditors and debtors, the fundamental history of which lie also in religion and the differences between Christians, Jews and Muslims with respect to usury (or "use" fees, i.e., interest) for borrowed monies.

It appears that the collection of usury on loans or debts has always had a rather contentious past in all three religions insofar as whether it should be charged at all on borrowed sums from banking institutions, or if so, the amounts and whether or not if the principal amounts are repaid, the usury amount remaining is still a true "debt," once that principal is repaid in the event of bankruptcy. In the U.S., interest rates on credit debt were routinely written off or slashed in federal bankruptcy court actions.

This was the case until several years ago the corporate banking attorneys lobbied for and were successful in getting the U.S. bankruptcy laws changed in order to make such write offs much more difficult. This was attempted under the Clinton Administration, very much a pro-Israel Administration but failed.

And yet, this year petitioned our Congress for their own "bankruptcy" bailout instead at the American people's expense. This fundamental bankruptcy code revision two years ago with respect to credit outstanding has further increased their profits and reduced their risks, while making citizen bankruptcy actions inordinately expensive and so complex at this point it takes the assistance of an attorney to muddle through from those who I have spoken with who have since gone through the process.

This revision was tossed around as indicated in the Clinton Administration before Bush, but Bush was a busy man and a great many monumental revisions in Washington occurred during his administration. Banks in this country now, if delinquent, in some states can raise interest rates, and in addition can and have assessed late charges and over limit fees on credit debt. In addition, it was only the past 10 years or so during the housing boom and post Keating that these creative ARMs were sold to homeowners, many of which were based on London LIBOR market rates exclusively instead of being based on U.S. prime which has also been a contributing factor in all the recent foreclosures left unsaid by the press.

Many were "usury only" or "interest only" loans, in effect merely a "use" right and not property purchase at all. Indy Mac, one such lender which went under used the London market for many loans.

The most interesting fact in my research was that under Muslim law and in Muslim countries, there are no "usury" rates per se as it is forbidden due to their religious beliefs. This would and could present a problem in countries such as Israel where the banks would charge fees on borrowed sums that the Muslim community would find religiously intolerable, and an abomination on their religious beliefs. Thus, the Muslim community have established their own banks inside Israel.

There was also an article recently in Reuters with respect to the largest Islamic bank in Gaza being caught in the middle of the conflict there with respect to suspected monies which Israel claimed may be in their bank and being deposited and held for or on behalf of Hamas members. The U.S. also joined Israel in placing pressure on the Islamic banks to cease any and all transactions for or with Hamas, as did the international banking community.

There has been much publicized recently in the past several years since the first Bush Administration about a "One World Government," and the global economy, with an eventual centralized bank in this global socialistic ideal. The ownership of most of the major banking institututions are held by Jewish banking houses, the result of the historic religious disparities between the three major religions with respect to usury, both the Christian and Islamic faiths opposing usury on religious grounds, which then forced the original Israelites and the modern day Jews to serve as the "moneychangers" and "tax collectors" in days of old.

As time passed in this country, due to the separation of church and state provisions of our Constitution and granting to our Congress the power to issue and regulate our coin and currency (this was the church's job in ancient history), those Christian "usury" objections and/or rates were left primarily to the states to determine and not the federal government.

Thus, the "legal interest rate" may be different from one state to another. The only legislation at the federal level has been with respect to federally chartered savings and loans, and installment companies which were exempted from usury restrictions as "private" contracts, not regulated at all. Which is why you will find a great number of credit card companies and banks incorporated in states with higher legal interest rates. Late payment fees and increases in usury or interest rates are now added on top of the original usury rates for delinquencies as stated above, plus also many times reductions occur in the credit lines themselves. A triple whammy profit for one late payment is pretty profitable for the bankers. And until I believe a recent class action suit, after reducing credit lines of late payees, many banks were then assessing overlimit fees which they themselves manipulated after reducing the credit lines on delinquent accounts.

The founder's would be apalled at the "loan shark" rates now charged by many U.S. banks and their total "usury" rates and fees, as not "Christian" at all.

It was telling and enlightening to read that since the Islamic faith at this point is the only faith that has strict religious prohibitions against usury contrary to the practices of all the private international banking communities with the exception of their own Islamic banks, the continued strife in the Middle East appears far more complex in the religious disparities than simply territorial disputes, nor would they be willing participants in any global world government dependent upon a non-Muslim centralized global banking system.

USURY RATES IN THE UNITED STATES:

Each U.S.state has its own statute which dictates how much interest can be charged before it is considered usurious or unlawful.

If a lender charges above the lawful interest rate, a court will not allow the lender to sue to recover the debt because the interest rate was illegal anyway. In some states (such as New York) such loans are voided ab-initio[18]

However, there are separate rules applied to most banks. The U.S. Supreme Court held unanimously in the 1978 Marquette Nat. Bank of Minneapolis v. Solving the U.S. Economy

With the economic crisis now foremost in American's minds, pushing back their concerns for the ongoing War in Iraq (a manipulated crisis at it's core, occurring just prior to the 2008 elections mind you), below are some suggestions for getting our economy back on track the "old fashioned," way - by abiding by the Constitution. I am concerned with Obama's suggestions, since as a Constitutional lawyer you would think he might consult it with respect to his policy making before making any more of his mesmerizing speeches. But it is clear this Administration is simply another promise of "change" without substance, that much has been clear since the changes in position he has made on both the war, and his economic plans.

1. Rescind the 700 Billion Dollar fraud of a bailout that was rushed through before the American people could become none the wiser, and which was covered up by the mainstream media acting in concert. This bailout was nothing more than a "payback" for those members of Congress, and the two presidential candidates, for their loans for their campaigns, billed at the American people's expense and will result in inflationary taxes that, no matter what pittance is rebated to the American people in the form of a stimulus package will only stimulate the coffers of the government once again in tax revenue. Obviously, the individual Americans had had it with the two party system that has merged essentially into one in defrauding the American people time and time again for their own agendas and purposes. It is called bi-partisanship, but is actually treason against the Constitution. A Ponzi scheme if ever there was one.

Instead:

2.Call in the loans of all countries whose balance sheets are now in the black, and whose currency is thus now also more stable, for all the foreign aid and loans we have made to them while our own economy has sunk in the process. No more foreign aid unless and until America gets some of those loans repaid, with interest.

3. Recall immediately all non-essential service personnel now serving in Iraq, leaving only the career army and diplomatic corp to oversee the arrangement of the transferring of the costs of the rebuilding efforts to their own government, since we were so very gracious in dethroning their latest dictator rather than abiding by the original Congressional Resolution calling for the capture of those strictly responsible for 9/11....Osama bin Laden and all those who directly gave him aid and comfort. The costs of this ongoing frivolous conflict are putting is putting our children and grandchildren's welfare and continued safety at risk, and also their own economic futures. If Mr. Obama cares about his two daughters, I am sure he would see the wisdom in such a position, unless it is his own financial future which is more important, or temporary political legacy as the "winner" of a "no-win" conflict. How can you defeat any enemy whose personal beliefs hold that dying for their jihad earns them their right in heaven. The logic of this continuing war based on that simple premise continues to astound me, and a good many other Americans.

4. Pass effective legislation calling for accountability of the Federal Reserve, and no more independent actions outside the oversight of Congress, per our Constitution that gives Congress, and Congress alone, the power to print and value our currency. Since that provision was unlawfully transferred by the Wilson Administration, then at the very least also provision should have been included to provide for strict regulation and oversight, not our Congress essentially working for them and their agendas. Also, enact sufficient oversight and regulation of those private banks who are recipients also of loans from the Federal Reserve and their policies in their dealings with the public. No more freewheeling and fraudulent bailouts, especially not for global industries, such as AIG.

5. Repeal the 16th Amendment that affords the majority of legislator's time and now a year around Congress to be bribed and forsake their oaths of office to the American people in favor of corporate and global interests and using their tax dollars in order to so do. We are at this point funding the entire world's economy, and tying our economy into that of other nations is how we got to where we are today, in debt and at the mercy of those international bankers.

6. Repeal the 17th Amendment calling for state legislative election of Senators, so that they again have a voice at the federal levels, and are not simply lobbyists at the federal trough for pork bills as another special interest group. No campaign election fraud with respect to the election of Senators, and Constitutional government once again. Institute the provisions that campaign contributions may only be accepted for House members from citizens, not corporate interests, that live in their districts. No outside state or federal funding. You cannot have a government of the people when the representatives serve outside interests, and not the people at all.

7. Since corporations only pay income taxes on their profits, tax them to the hilt. Then maybe those profits will trickle down to either the employees, or into research and development costs in order to protect their investment the old fashioned way - by reinvesting in it rather than the Boards of Directors and upper level management skimming the profits. Institute regulations that call for investor/stockholder approval of all severance and bonus packages to eliminate "golden parachutes." The investors own the company, so should have a say in the compensation for which these top level management employees are entitled and worth. Not them self-determining, in many instances, their own salaries and severance packages.

Those are just a few, but there are so many more Constitutional abridgements which have been enacted, that it would take days to address them all. But those "Lucky 7" would truly be the legal and Constitutional way to reverse what has brought us to this point, at least initially.

The Bailout: Political Corruption at It's Finest

In September of this year the 110th Congress passed what is now infamously labeled "the bailout bill" during a purported crisis prior to the 2008 presidential election. In a previous article, I had disclosed through research conducted at OpenSecrets.org that the recipients of the majority of those earmarked bailout sums were for banks, financial institutions, and a global London based insurer (AIG) which also just so happened to be the top corporate donors to the campaigns of both parties presidential hopeful and members of Congress, committing what actually is no more than treason upon our Constitution and system of government as watchdogs over the public purse for expenditure of public sums for it's enumerated powers and public duties.

While awaiting the final vote count during this travesty and crime committed against the American people, in retrospect now it is incomprehensible that not a single legislator had the integrity or loyalty to his oath of office to abstain from the vote process as a clear conflict of interest. Outraged as many Americans were and still are, I read the background and our Constitution with respect to the original provisions in the election of true representatives of the people as they had intended. Amazing how brilliant those men truly were.

Just think if we returned to the manner they intended how our economy and all else would change. As originally intended, the state legislators themselves elected the Senators from among their various legislatures to represent the states in Congress (no campaign finance problems here), and the representatives of the people were only allowed to accept campaign donations from individuals and/or small businesses within their district (no campaign finance problems there either) and voting precincts. Net result: Constitutional government, and no political graft or pork benefits. No trillion dollar deficit.

Those banks and AIG did not make those campaign contributions, after that bailout bill was shoved through Congress, the American people did - whether they supported those candidates or not. Those entities simply loaned those candidates sums to fund their campaigns, and quite obviously at an interest rate that would feed a third world nation, such as ours is becoming due to the political corruption running rampant in Washington.

The only "change" which appears occurred this election cycle was a "change" in the manner in which even the ridiculous campaign finance laws that are now in effect are being creatively circumvented, and the continued anarchy upon our Constitution continues unabated and which have hit new lows in corporate fraud against the citizenry. The corporate privileges and immunities now given by Washington includes reimbursing them for their campaign contributions from the public purse. Or taking out interest bearing loans to fund their campaigns while billing it to the American people under a fraudulent bailout bill just prior to an election and stating that it was done in order to protect Joe Citizen's 401(K) painting themselves as the saviors of middle America.

Even Benedict Arnold didn't sink that low in his treason against our nation on behalf of London or compromise our sovereignty and economy to such a degree on behalf of sovereign subjects or corporate welfare. He simply took up arms and joined the other side, but didn't feed the founders or this nation, it citizenry and their posterity's future to the wolves.

What's Wrong With Roe v. Wade (And Why The Liberals Don't Get It)

Even thirty years after this controversial decision, the jury is still out on Roe v. Wade. Decided in the early 70's, I remember well when the case was decided, as I had just completed high school. For many, it was one of those days stuck in your brain due to it's reach and "precedent," along the lines of the day Kennedy was assassinated. A monumental moment in history, and now even in the 21st Century, the controversy still reigns.

When the decision was reached, it turned our country quite upside down and polarized. Interesting, historians and others who bring Roe to the forefront in political discussions and discourse, and of course at election time, fail to also mention that at the time Roe was decided, the Pill and other rather reliable methods of birth control were becoming more and more available. Planned Parenthood had just opened it's doors to "free birth control" during this "free love" era, and AIDS was nothing more than an employment term for an assistant. At the time it was decided, there were many states which did allow early abortions, since this also was the time when the "globalists" had started their scares about overpopulation, and the destruction of our planet. It is now, of course, being resurrected by many of those former hippies, and capitalists types as the new scheme in which to become a millionaire before 35. Seems out in California there is now a blend of "hippie capitalists." They don't mind being that dirty word "capitalists" so long as they are making their fortunes along environmentally friendly lines, and saving the planet from overpopulation is one of them.

Many of these left wing pro-choice activists believe in unrestricted access to abortion, such as third trimester partial birth abortions, including from all accounts the Democratic nominee. The defense has been with respect to that Illinois bill a fear that in supporting the partial birth ban it might overturn Roe v. Wade, and was worded incorrectly. My understanding is that was what the committees in the state legislatures were for, reviewing laws for Constitutionality prior to bringing them to the floor for debate on major legislation, and Roe actually only addressed and upheld the right to first term abortions since those were already allowed in most of the states, for rape, health of the mother, and had been expanded for teen pregnancies so long as there was parental consent, which provision has been now even unconstitutionally removed in many states. 

For all the scare tactics the libs like to throw out every election about the "threat" of Roe being overturned if, horror of horrors, a Constitutuion believing conservative should get into office and further stack the Supreme Court, I have just one thing to say.......don't you think it's about time that decision was reviewed, now more than thirty years after the fact?   At this point throughout the country, we now have even the "Morning After" pill, for heaven sakes. Birth control pills now in many areas of the country can be obtained by even teens without their parent's consent, and due to the AIDS and other STDs epidemic, the use of contraceptives between committed or uncommitted couples have never been higher. Isn't it about time we pulled the plug, at least, on second and third trimester abortions nationwide, except in the event of health risk to the mother or child in continuing the pregnancy? Just what are you liberals afraid of, that in so doing we will go back to the dark ages, where abortions were performed in dark alleys with unsterilized equipment, when now there is even a pill that can abort during the first trimester?

As a Christian, I believe abortion should be restricted to the first trimester at this point in our history, and not simply for moral reasons but also legal ones. This was never a "right to privacy" issue to begin with, it was always a "right to life" issue, since if the founder's were not concerned with "life" they certainly wouldn't have based an entire document in order to secure "life, liberty and happiness" for "us and our posterity" if they were unconcerned with just what the "Creator" would think. And it's pretty clear there is 10 Commandment law behind that Constitution, whether the atheists in this country wish to believe it or not. Religious tolerance is actually a Christian doctrine, it is not a Jewish, Muslim, Hindu or Buddhist doctrine, and the freedom of religion provision was also provided in order to prevent a NATION-WIDE or "State" religion, such as they had experienced in England with the decades long fighting between the Catholics and the Protestants. Read Ben Franklin's speech when the Constitution was ratified, and he specifically alludes to the problems they were attempting to avoid by recognizing each individuals right to worship God according to their own understanding, and in their own way, without "nationalizing" a state religion such as in Britain and the Church of England, and in more recent history, Israel. It does seem the founder's new what they were doing, since even today those countries with "national" religions do seem to be engaged in much more strife, both internal and external, than others.

The problem that I do have with the far, far right wing evangelical Christians is their rather rigid interpretation of when life begins, since Jesus never truly addressed it. Most pastors and members of the evangelical churches relate to the biblical passage of God "knowing you in your mother's womb." The problem I have with that is that adultery was a criminal matter in Jesus's time, and the punishment under the 10 Commandment law at the time was death by stoning. If life truly begins at conception rather than viability, than God allowed innocent fetuses to be killed along with their mothers since I'm sure a great many of those adulteress might have been pregnant. It is also Biblically fairly clear that the first life God created, Adam, he did so by "breathing" life into dust, and that in then creating Eve, he clearly then gave them, not he, the gift of procreation and then by directing them to "go forth and multiply." And it's also pretty darn clear that he intended children to be raised in two sex households, since he didn't give us the ability to recreate independently of the other sex.

What is truly amazing to me is that for all the bravado of the "pro-choice" movement and those mostly liberals who even today with medical knowledge and technology the way it is, still cling to this decision as a benchmark of a candidates worthiness. It is interesting that while the radical liberal element protest over global warming and how it is affecting the whales, polar bears, and other Arctic creatures, they were nowhere to be seen when Teri Schiavo was judicially literally starved and dehydrated to death for almost 14 days while she clung to life, breathing on her own. The most painful type of death any human can experience ending in progressive organ shutdown, and a judge in this country so ordered it. Better watch out, liberals, since your definition of "pro-choice" and radicalism sounds more like Germany, circa World War II.

NOTE:  Due to the timing of this bailout bill heard in conjunction with the AIG Bailout in September with less than a week's deliberation, the single digit now approval rating for Congress, rushed and "under the table" administration provisions contained within under simply the Secretary of the Treasury's sole discretion, and  prior to then releasing Congress and Congressional members so they could go back to their district's to being their re-election campaigns, wonder just how much of this money was presented as a needed bailout, but in fact were sums needed for these anarchists to use for their campaigns to remain in office. 

More an "insider trading" and "loan" to these Congressmen, than a bailout - or more accurately, a "bailout" of the foreign investors that "took a risk" and lost in buying mortgage backed securities on the secondary market - Fannie Mae and Freddie Mac had plenty of money due to their pyramid scheme - it was the foreign investors that lost, and the American people are being used to pay them back for these banks fraud on those investors who were not accurately apprised of the risks involved in buying securities on the "secondary" markets.

What fraud...each one of these Congressmen and those that voted for that bailout should be "arrested" and charged with anarchy under the Constitution.

Top Campaign Contributors for Election 2008

The Center for Reponsive Politics (OpenSecrets.org) has compiled a listing of the top individual contributors during the 2008 election cycle. No surprise, the top donations came from the bailout recipients, banks and financial institutions, and mainstream media moguls...the ones who are affiliated who will now be paid back with your taxpayer dollars for the donations through the bailout bills, and the media who couldn't shove the bailout down America's throats quick enough......so quickly that it is now under simply under the auspices of Secretary Paulson (ex-Goldman Sachs employee, and unless there is another Henry Paulson with Goldman Sachs, appears on the list as a donor also, or maybe a son) and soon Mr. Geither (Federal Reserve New York) outside the scrutiny of the American people (thanks to the members of Congress who drew straws, depending whether or not they were up for reelection, reimbursing their benefactors in September just prior to leaving Washington to campaign for re-election.  This is American politics - one hand washes the other, building up their wealth, and sells out the American people to the global bankers at the Fed for their profit margins in it's deficit spending and inflationary taxes.

Next up, a stimulus package and a few crumbs now for Americans from the "leftovers" of the 70 billion Congress and the President, both past and future, borrowed to pay back it's campaign backers. Obama was second on the list in the amount of donations from Freddie Mac, you will remember (although McCain was on that list also). 

When viewing the list, keep mind that AIG is a London based insurer, not U.S., and that Goldman Sachs is an owner and shareholder in the Federal Reserve, a private, not public, bank of national and international financial institutions, which was created by an unconstitutional Act of Congress during a winter recess in the Wilson Administration, and which Wilson near his deathbed predicted the ultimate eventual demise of America at due to the unrestrained power given them in unlawfully privatizing our banking system. Such prediction came to fruition not nine years later when the Fed manipulated the Great Depression, and appears is on it's way to sending America back to the 30's once again. Amazing what corrupted men will do to their fellow man when given such immense and unbridled power:

Who Owns the Federal Reserve?

So we have an ex-employee, Henry Paulson, and upcoming current employee, Mr. Geither who are going to oversee that 700 billion bailout outside the scrutiny of Congress or the American people.  AIG a London based global insurer, and Goldman Sachs and Lehman Brothers, who own the Federal Reserve, going to Congress for a bailout from the Federal Reserve, and also members of the international banking cartel and Israli lobby?  Who claimed "bankruptcy" but had been contemplating going to Congress for a "bailout" from, what, themselves as owners of the Federal Reserve, the entity funding these bailouts and whose corporate interests were the top contributors to those campaign chests from whom they were requesting assistance?  Sounds like those banks simply wanted immediate repayment with interest for their campaign contributions, at the American people's expense and they got it.  Obama took public financing as did additionally McCain in their affirmative votes for those bailouts.  The new "privileges and immunities" given to corporate interests, including global ones, is repayment for their campaign contributions at the American public's expense, whether they agree with those candidates or not.  Seems like the current Democratic and Republican parties have merged into the Global Socialist Party whose candidates are now funded by the international banking cartel primarily for their one world government agendas and profits most of all.....war does stimulate the bankers economies, after all, it is not peace in the Middle East these vultures, and their Congressional minions want.....The only change which occurred this passed election cycle was the creative manner in which the Fed and Council on Foreign Affairs members and incumbent Congressional members used to skirt around even the ridiculous campaign finance laws.  McCain a campaign reform reformer? By his affirmative vote, hardly.  Obama a instrument for "change?"  Yes, change in bringing the Illinois down and dirty politics to the federal level.  His honesty isn't the type we refer to when that other former president, Lincoln, is brought to mind....the one that also took on the international banking cartel and ended up assassinated for his efforts.  Mr. Obama sold out Malia and Sasha's economic future in that one act of high treason for his own political career, and his oath of office and allegiance to our Constitution as a sitting senator has already been tested, and one this one act of high treason alone he has been found not simply wanting but another Bush "damn piece of paper," global socialist along with the rest of the merry band of bandits from the Council on Foreign Relations he has stacked his new administration.

This is the new America in the 21st Century.....What's wrong with this picture?

Upset About the Bank Bailouts? You Should Read This

In September of this year the 110th Congress passed what is now infamously labeled "the bailout bill" during a purported crisis prior to the 2008 presidential election. In a previous article, I had disclosed through research conducted at OpenSecrets.org that the recipients of the majority of those earmarked bailout sums were for banks, financial institutions, and a global London based insurer (AIG) which also just so happened to be the top corporate donors to the campaigns of both parties presidential hopeful and members of Congress, committing what actually is no more than treason upon our Constitution and system of government as watchdogs over the public purse for expenditure of public sums for it's enumerated powers and public duties.

While awaiting the final vote count during this travesty and crime committed against the American people, in retrospect now it is incomprehensible that not a single legislator had the integrity or loyalty to his oath of office to abstain from the vote process as a clear conflict of interest. Outraged as many Americans were and still are, I read the background and our Constitution with respect to the original provisions in the election of true representatives of the people as they had intended. Amazing how brilliant those men truly were.

Just think if we returned to the manner they intended how our economy and all else would change. As originally intended, the state legislators themselves elected the Senators from among their various legislatures to represent the states in Congress (no campaign finance problems here), and the representatives of the people were only allowed to accept campaign donations from individuals and/or small businesses within their district (no campaign finance problems there either) and voting precincts. Net result: Constitutional government, and no political graft or pork benefits. No trillion dollar deficit.

Those banks and AIG did not make those campaign contributions, after that bailout bill was shoved through Congress, the American people did - whether they supported those candidates or not. Those entities simply loaned those candidates sums to fund their campaigns, and quite obviously at an interest rate that would feed a third world nation, such as ours is becoming due to the political corruption running rampant in Washington.

The only "change" which appears occurred this election cycle was a "change" in the manner in which even the ridiculous campaign finance laws that are now in effect are being creatively circumvented, and the continued anarchy upon our Constitution continues unabated and which have hit new lows in corporate fraud against the citizenry. The corporate privileges and immunities now given by Washington includes reimbursing them for their campaign contributions from the public purse. Or taking out interest bearing loans to fund their campaigns while billing it to the American people under a fraudulent bailout bill just prior to an election and stating that it was done in order to protect Joe Citizen's 401(K) painting themselves as the saviors of middle America.

Even Benedict Arnold didn't sink that low in his treason against our nation on behalf of London or compromise our sovereignty and economy to such a degree on behalf of sovereign subjects or corporate welfare. He simply took up arms and joined the other side, but didn't feed the founders or this nation, it citizenry and their posterity's future to the wolves.
